Terms of Service

These terms are an agreement between you and Abantu LLC ("Abantu Audio", "we", "us") covering the Abantu Audio mobile application and the account and checkout website at account.abantuaudio.com. By creating an account or using the service, you agree to them.

1. Your account

You must be at least 13 years old. You are responsible for keeping your login secure and for activity under your account. Provide accurate information and keep it current.

2. What we provide

Abantu Audio is an audiobook and podcast streaming service focused on Black authors and narrators. We grant you a personal, non-exclusive, non-transferable, revocable licence to stream content for your own non-commercial use.

You do not own the audio. Titles are licensed to you, not sold. You may not download, copy, record, redistribute, publicly perform, or attempt to circumvent any access control on the content. You may not share your account credentials.

3. Samples, membership and credits

Samples. Without a membership or a purchase, you can listen to a preview of a title — currently the first five minutes. Podcasts are free and available in full.

Abantu Pro membership. A recurring subscription that lets you stream the catalogue for as long as your membership is active, and includes a credit each billing period. Billing recurs automatically until you cancel. When your membership ends, streaming access ends — but any title you bought with a credit remains yours.

Credits. A credit buys one audiobook, and that title stays in your library permanently, including after a membership ends. Credits do not expire. Credits have no cash value, cannot be transferred, sold, or exchanged for money, and cannot be redeemed for anything other than titles in our catalogue.

We may add or remove titles from the catalogue at any time. If a title you purchased with a credit is removed from the catalogue, we will make reasonable efforts to keep it available to you, but licensing changes outside our control may occasionally prevent that.

4. Payment

Purchases are made through our website using Stripe as our payment processor. Prices are shown before purchase. Taxes may be added at checkout depending on where you are.

Membership renews automatically at the then-current price for your billing period until cancelled. You can cancel any time from your account; cancellation takes effect at the end of the period you have already paid for, and you keep access until then. We will give notice before any price change affecting your renewal.

5. Refunds

All sales are final. Credits and membership fees are non-refundable except where required by law.

Cancelling a membership stops future billing. It does not refund the period you have already paid for, and you keep access until that period ends. Credits, once spent on a title, are not returned.

Your statutory rights are not affected by this section. Consumers in some jurisdictions have refund and cancellation rights that override it, and nothing here waives them. Where such a right applies to you, we will honour it — contact us at info@abantuaudio.com.

6. Acceptable use

Do not use the service unlawfully; attempt to access accounts, systems or content you are not entitled to; scrape, crawl or bulk-download the catalogue; reverse engineer the app; interfere with the service's operation; or resell access.

We may suspend or terminate an account that violates these terms, or where required by law.

7. Deleting your account

You can delete your account from within the app. Your account is deactivated immediately and any active membership is cancelled at that time. Your data is permanently erased after 30 days. Signing in during those 30 days restores your account, your library and any unspent credits — your membership is not restored, and you would need to subscribe again.

After 30 days, your library, credits and listening history are gone and cannot be recovered. See the Privacy Policy for the anonymised financial record we retain for accounting and royalty purposes.

8. Changes to the service and to these terms

We may modify or discontinue features. We may update these terms; if a change is material, we will give notice in the app or by email before it takes effect. Continuing to use the service after a change takes effect means you accept the revised terms.

9. Disclaimers

The service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that any particular title will remain available.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us in the twelve months before the claim, or fifty US dollars. Some jurisdictions do not allow these limits, in which case they apply to the maximum extent permitted.

11. Governing law and disputes

These terms are governed by the laws of Texas, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts located in Texas, and you and we consent to that jurisdiction.

These terms contain no binding arbitration clause and no class-action waiver. Nothing here limits your right to bring a claim in court, including in small-claims court.

12. Apple

If you obtained the app through the App Store: these terms are between you and us, not Apple. Apple has no obligation to provide support or maintenance for the app. Apple is a third-party beneficiary of these terms and may enforce them against you.
